The Legal Profession: Attorney or Lawyer?

In England and Wales, there are two types of lawyers:

 

Barristers

 

 

Are specialists in advocacy. They give opinions on areas of law to solicitors and clients. Originally you could only instruct a barrister through a solicitor but it is possible to now instruct a barrister directly.

After successfully completing the BVC (Bar Vocational Course) / BPTC (Bar Professional Training Course) Barristers are Called to The Bar at one of the four ‘Inns of Court’.

If a newly qualified barrister wants to practise, they need to obtain a pupillage at at a set of chambers under the supervision of a pupil master. Pupillage can also be performed at some companies and institutions. Pupillage for a barrister is the equivalent of a training contract for a solicitor.

 

Inns of Court

 

There are four Inns of Court which are based in London. Middle Temple, Grays Inn, Inner Temple and Lincolns Inn. As well intensive study, irrespective barristers need to dine at their Inn a specific number of times.

Solicitors

In the US, lawyers are referred to as attorney at law or simply as an attorney. In the US and UK, Judges in the US and UK are experienced lawyers.

Legal Practice Course

Further to attending the Legal Practice Course, trainee solicitors need to complete a training contract of two years at a law firm where they will gain the experience of working in in different areas of law under the supervision of senior solicitors.

Practising Barristers and some solicitors have right of audience which means they can represent their clients in court.
